Terms of Service

These terms cover both the website and any commercial transaction that follows from it, including how quotations, inspection and claims are handled.

1. Scope

These terms govern your use of ruichuangmetal.com and any quotation, order or shipment connected with it. The site is operated by Hubei Ruichuang Metal Products Co., Ltd., Room 1409, Building 4, Aoshan Century City, Hongshan District, Wuhan, Hubei Province, China. By using the site you accept these terms.

Nothing on this website is itself an offer capable of acceptance. Product pages, specifications and any indicative pricing describe what we are able to supply. A contract of sale comes into existence only when we issue a written proforma invoice or order confirmation and you accept it.

2. Quotations and Pricing

Quotations are issued in writing and state their own validity period. Metals traded on the London Metal Exchange, which include copper, lead, zinc, tin and nickel, move daily, so a quotation that has passed its validity date is indicative only. Please confirm pricing on the day you intend to commit.

Prices are quoted FOB or CIF as stated in the quotation. Unless a quotation says otherwise, duties, taxes and import clearance in the destination country are the buyer's responsibility.

3. Specifications, Inspection and Acceptance

Specifications are as stated in the quotation and in the certificate of analysis issued with the lot. The buyer is responsible for confirming that the specification is suitable for the intended use.

The buyer may nominate an independent inspection agency, such as SGS or BV, to sample and inspect before shipment. Unless agreed otherwise that inspection is at the buyer's cost. Where a pre-shipment inspection has taken place and been accepted, the report is treated as confirming quantity and quality at the point of loading.

4. Delivery and Risk

Delivery terms are those stated in the quotation, interpreted according to Incoterms 2020. Risk passes as those terms provide. Any delivery date given is an estimate unless the quotation expressly guarantees it.

5. Claims

Claims for visible damage, shortage or non-conformity must be notified to us in writing within the period stated in the sales contract, supported by the inspection report and photographs. Where a pre-shipment inspection was available to the buyer and was not used, we are not liable for loss that inspection would have identified.

6. Liability

Our liability in connection with any order is limited to the value of the goods in that order. We are not liable for indirect or consequential loss, including loss of profit or loss of production. Nothing in these terms excludes liability that cannot be excluded by law.

7. Force Majeure

We are not in breach of these terms where performance is prevented by events outside our reasonable control. These include export or import restrictions, changes in customs or regulatory requirements, port closure, and interruption of transport or production.

8. Intellectual Property

Text, photographs, specifications and page design on this website belong to Hubei Ruichuang Metal Products Co., Ltd. or are used with permission. You may reproduce product specifications for the purpose of evaluating or reselling our products. You may not republish the site content as your own.

9. Governing Law

These terms, and any contract arising from them, are governed by the laws of the People's Republic of China. The parties submit to the jurisdiction of the competent court in Wuhan, Hubei Province, unless the sales contract specifies arbitration.
